1. Scope of Application These Terms and Conditions apply to all orders placed via the online shop on the website www.johannesraschke.de (hereinafter referred to as the "Webshop"). The Webshop is operated by: Johannes Raschke,
2. Conclusion of Contract via PayPal Payment The products presented in the Webshop do not constitute a legally binding offer but serve as a non-binding invitation to submit a purchase offer. Orders are processed via the payment service provider PayPal. After selecting your desired products, you will be redirected to PayPal’s payment page. By entering your personal data and completing the payment via PayPal, you submit a binding purchase offer. The contract is concluded once your payment is confirmed by PayPal. Upon successful payment, you will automatically receive an order confirmation via email.
3. Prices and Payment Terms All prices are stated in euros and, pursuant to § 19 of the German VAT Act (UStG), do not include value-added tax. Products will be shipped only after full payment has been received.
4. Delivery and Shipping Shipping is available both nationally and internationally via Deutsche Post/DHL to the address provided during the PayPal checkout process. Packaging and shipping costs are charged at a flat rate of EUR 20.00 and are clearly displayed in the shopping cart. Ordered items are usually handed over to the shipping provider within 10 business days after receipt of payment. You will receive a shipping confirmation by email including a tracking number once your order has been dispatched. Actual delivery times may vary depending on the destination country and are beyond my control.
5. Right of Withdrawal Consumers are entitled to a statutory right of withdrawal of 14 days. This right does not apply to works that are individually produced at the request of the customer. The full cancellation policy can be found under Cancellation Policy.
6. Retention of Title The delivered goods remain my property until full payment has been received.
7. Warranty Statutory warranty rights apply. Please note that slight color deviations between on-screen previews and printed works are technically unavoidable and do not constitute a defect.
8. Copyright All offered artworks are protected by copyright. By purchasing, you acquire only the physical product, not the usage or exploitation rights. Reproduction, distribution, or public display is not permitted.
9. Jurisdiction and Applicable Law German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from the contractual relationship is the seller’s registered address, provided the buyer is a business customer or has no general place of jurisdiction in Germany.
10. Online Dispute Resolution The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. I am neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
